We recently had our Pres. move and the vacancy was filled by an appointment. Nothing unusual there but this person was then voted as President at the next meeting, with no experience at all.

She has to constantly say, "I don't know" or "I'm not sure".

Is there a rule in California that says Appointed Board members may not serve as Officers? It would make sense in a way.

The answer is no.

The cruel joke sometimes played on new Board members when others don't want to do anything is to appoint the "newbie" as President.

Be careful what you ask for.

I don't see why an appointed director would be any less qualified than a newly elected one.

to reach a compromise, when there was a tie vote my first term as director for president, a newcomer to the board and the HOA was selected. Was the worst--though knowledgeable about real estate law to some extent, knew nothing about HOAs. Not only that, he only lived part time here.

Please remind us each time, Thomas, are you on the board? What do your Bylaws say, if anything about who may an officer? Why did the board vote for her?

Can't the VP help her out? Or your PM take her under their wing?

Yes on the board for 2 months now. Only 2 new members, 5 remaining from recall attempt so not a lot of love going around for the of us who are new. Recall going to Civil Court as proxies were disqualified even with current homeowner as proxygiver. Homeowner list was not kept up to date by PM.

PM just got fired for the Homeowner list issue and taking $400 on call stipend while on call pay was already included in her contract with MGMT. Co.

President I was initially referring to has resigned herself to Secretary as she was in over her head.

Secretary traded places with Pres. Not much better as he is disliked by majority of homeowners.

It will all have to play out in court.

problems for as far back as I can remember, we seem to have an entrenched culture of board vs. homeowners.

that is why I got on the board.
