I bought a property several years ago (about 8) and to this day the HOA has never conducted a meeting or transferred the association to the owners. Myself along with many other owners has many issues with the property but really don't know who to contact to voice our issues. As owners, can we force the owners of the property to establish a HOA board? If so where do we begin? We have many issues like common areas being maintained as well as the owner renter ratio.

I would go to the records office at the local courthouse to get a copy of your CC&R's. You may need to go to a state website for the Articles of Incorporation. Both documents are considered PUBLIC. So if they do exist, you and your neighbors should have access to them.

Verify your not still under development control. If you are, then not much you can do but contact the developer. Who may or may not have a member board set up.

It's important to do the basics first. That is to find out officially how your HOA is set up and who is in control. Once that is established then it will lend to the best way to handle things. No reason why either way you and your neighbors can't form a committee. It may be just for preparation of when turnover occurs. Remember a HOA is only managed by it's members for it's members. (Unless the developer is still in control). It's about time interested owners ban together to get interested.

If the Association has not been transferred to the owners, then you need to contact the builder/developer directly as they would be the ones in charge of the Association.

Do you pay assessments?

If you do, send a letter to that address asking for contact information.
