I purchased into a 265 single unit complex managed by the same company when the units were built in the 80's. over the course of 5 years of my ownership and while attending the monthly open HOA meetings I discovered too many items being discussed with no outcome. When I questioned the management's Minute taker "Account Advisor" he informed me that I was harassing him (with a shouting match) so I stopped going to the meetings. Now I'm beginning to think that he attempted for me to stop attending the meetings. I as many other owners believe that the HOA's collection of our funds are being mismanaged and probably for many years. Many of the owners have attempted to contact the 5 Board Members about changing management and provided them with several capable companies that were phoned interviewed. The Board has used our financial funds at Christmas time to fund a Christmas event for the management company's employees and spouses. no where does it allow such an expense in our CC&R's, as a matter of fact were running in the RED. The end of the year financial report that we owners receive does not even disclose this expense. This has created an up roar among some of the owners for mismanagement of our funds. The Board refuses to discuss changing management, what can we do?? California

The board is elected to run the association, similar to how city/county commissioners are elected to run those jurisdictions. Also similarly to how citizens have little to no direct control over the vendors the city/county uses, homeowners don't directly control that in an association.

The obvious answer is to elect a new board. The simplest way is to campaign heavily before the annual election to get new board members (yourself, perhaps) elected. There is also the possibility of a recall election, read your governing docs to see what the requirements are for your association.

It's not the changing of the MC as much as the changing of your board... The MC is a hired contractor to the HOA. Do you have anyone willing to run for the board? Can't replace the board without anyone there ready to replace them. Your already ahead of the curve if anyone has taken the effort in researching new MC's. Most people don't do that beyond complaining about the MC.

Thank you for the sound advise. We recently voted in a Board Member who decided to drop out after the other Board Members informed her to not question the other long standing members decision. I will definitely petition other owners to place their name on the ballot. You may be right that we need a new Board. Thank you.

I understand your dilemma. The actions of your "account advisor" was probably done purely to deter you from getting involved in the HOA. The less people involved the easier it is for the BOD to do what they want. I would also guess that if the BOD refuses to remove the MC there's more going on between the MC and BOD. I am guessing that with 265 units your annual revenue is around 1 million. It's not very hard for $50k to go missing without notice. I've spent the past two years with a Corrupt BOD and MC. You must connect with other HOA members that share your opinions. Start requesting financial records. Get familiar with your CC&r's and Daivs-Stirling act. If your running in the "RED" and the BOD has money for a Christmas party for the MC somethings wrong.

Easier said than done. If members are not involved or many units rented this can be a huge task. As in my situation we are 226 units over 50% are rentals. Most owners that live here don't care or are older and have been bullied by our BOD. I agree get familiar with your CC&r's regarding elections. It may be easier to recall BOD.
