I've been using this forum for awhile so I am hoping someone might be able to help me edit something. Last year, I added my fiance to the title of the house with a quit claim deed. Now, she needs to come off of it. Woul anyone be able to let me email them the quit claim that was filed and help edit to so that it goes from me adding her to me removing her? I don't want to copy and past the quit claim into the forum. This is kind of important to me. If anyone can help, email me at [email protected]

First question, and it's a biggie. Is she agreeable to this.

If the answer is yes, and she's not on the mortgage, then your county clerk probably has the paperwork.

If the answer is no, get an attorney and head to court.

She's agreeable and is not on the mortgage...just the deed. The clerk's office will not help on it.

How are you askinging the clerks office. They are prohibited from giving legal advice, so they could be acting upon that prohibition.

Or they could be jerks.

Each possibility is equally possible.

As I understand quit claim deeds, you either changed the tenancy of the deed or (worst case) you surrendered your claim of the property to her.

Either way, as I understand it, she would have to initiate or agree to the action and quitclaim the deed back to you.

My advice, spend some money ($300 - $1,000) and get an attorney's opinion of your options.

Money well spent considering it's your home.

I don't think there's an "unquitclaim" process. She would need to quitclaim her interest to you. I assume you filed a quitclaim for 1/2 of your interest to her, she will need to file one for 100% of her interest to you.
