I m a homeowner I have an A/c on my window no ugly boards just AC at the bottom of the window. Other homeowners have them too. Some homeowners have ugly fences . And use it as storage yet I been target to take my AC down and not been allow to use the pool . It was an incident with one of the board members a guess talk back to him . ( I'm no longer friends with this person and we are not the same person but every since I been harassed . And single out . Do I need to take legal action . This building were constructed defected with pluming issues. The builders were suit but they file buncrucy . Needles to say central AC does not work . I feel because the special circumstances the window AC should be alowed .thank you for any feed back

I'm sorry to hear of the problems you are having with your HOA.

If others have window A/C units, talk to them and find out if they received prior approval or not. If they did, simply request permission and point out that your only asking for approval of something others have received approval for.

If there are medical conditions, then get a doctors note for the A/C (something that you should not be in the heat) and then ask for reasonable accommodations due to medical reasons. Explaining that as soon as the Association repairs the central A/C, you will remove the window unit.

If you desire, contact a local attorney to see what your legal options are.

Welcome Irma, Tim has some very solid points. You may also want to check with your States Fair Housing Office. It is sad, but in most States, heat is a requirement, but AC, is considered a luxury. Above all else, take pictures and keep notes. If you do need to seek legal advice, this will go a long way. If you are above a certain age, you can also look at that approach as far as discrimination. If you can afford to, have an AC specialist come out and give you a statement as to your AC problems. The more "official" paperwork you have, the better off you will be, concerning this issue, of what stinks of "Favoritism".

It sounds like you're in a multiple-story building, right?

wonders if this is an insurance thing. i'm sure that the HOA would not want to get sued if it fell on someones head. NOT saying that it would happen is there just not willing to chance it..

have you thought about getting a portable AC unit you know the ones with the hoses on wheels

Find out in writing what the Board's objection is 1st. If it's not a safety violation, keep in mind that if the a/c unit has been there for about 5 yrs without a Notice from Board to remove it, the Board probably will lose if challenged in court.
