Back for last time on Rouge, illegally elected president etc.

Here is where we stand with the 5 legally elected board members.

1 good friend of this president
2 Want to get rid of any way possible
1 Maybe she will not run again, only 6 months to go.
1 I don’t know. (Very shy person)

Just yesterday, A home owner that she accused of buying a home illegally
because it was a corporation and then rented the home a month later
was against our bylaws and he needed to put the house up for sale. Which he did not due.

The house was bought under his own name and article 10 says a corporation can buy
a home. This owner did not sell and now wanted to rent again, his tenants needed to leave early.

Yesterday after a former president of our community and a Realtor found new renters and wanted to set up a meeting to interview with the new tenants. She refused to call a meeting with board members too interview the new tenants for a month or more. Four of the other board members are meeting with the renters Monday against the orders of the President.

As you might guess I am one of the rid of here any way possible.

I have also considered sending a letter to the management company saying I believe we have to many board members what should we do.

PS I am 50/50 on signing it with my name.

So, Donel....please review the replies we gave you when you previously raised this topic. Just because she's done yet something else improper doesn't mean anyone's advice will change.

Meantime, persuade the board that it, as a whole at a meeting, must make decisions with their votes. The prez has no such authority.

I actually disagree on sending the letter to the MC.

First, check your governing documents to see how many Directors are authorized.
If the actual number meets or is less then the authorized number, such a letter would make the sender appear uninformed of the governing docs.

For those who may be trying to follow the issue, it all seems to stem from rental restrictions and what document the restrictions are in and has appeared to roll into a personality conflict with the President of the Association.

See:

Subject: Very worried, HOA New amendment rental restriction started by DonellJ on May 12.

Subject: Do rental restrictions have to be only in our started by DonellJ on May 22.

Subject: Reasonable ideas to grandfather centain owners from new rental restrictions started by DonellJ on June 2.

Subject: We have decided to grandfather owners of rented homes. from a new amendment. started by DonellJ on June 9.

Subject: Demote President to director started by DonellJ on July 19.

Subject: New Pesident & Mgnt Company are they breaking the law started by DonellJ on July 20.

3.1.3 The number of directors shall remain at five (5) unless said number shall be changed by a vote of the Association membership at a meeting to be held at least six (6) months prior to the time for the election of the Board of Directors

I also agree ... if there is something wrong against the best interest of ALL other HOA members then stand up and sign your name!!! If you are not willing to stand up then potentially they are right and you may be wrong (and reason you are not willing to stand up).

Keep in mind HOA's, restaurants, or any other business (profit or non-profit) cannot FIX problems unless they are made aware of any potential problems. All members not only have a right but also a responsibility to report problems. Just as all Citizens are supposed to report crimes or potential crimes. Why ... because certain issues cannot be avoided or fixed without knowledge. If anyone has an issue they should not go around behind everyone's backs ... instead they should stand up and state their facts.
