Hi All,
We have one home owner who does car repairs in the community.
And with this he blocks the community road with his service cars. letting only one car to pass by.
Can a homeowner do this in a community?
Where can I find the laws/rule that they cannot perform business in the home they are staying.

If the roads are public, that information is avaiable on the net or the jurisdiction owning the roads such as a county or town.

If the roads are owned by the HOA, then look in your CC&Rs

Lava, check your Declaration of Covenants, Conditions, and Restriction (or whatever name lists the restrictions). This will most likely state that no business can be conducted (which can be seen, heard, or smelled) or else at a minimum should have a "nusaince" clause which can be applied.

If you lack the documents mentioned above, check with your local register of deeds for copies. Your local municipality might also have the information. They might also have their own ordinances against the activity. I'd start with the municipality and see if they can help without having to address it through the HOA.

I suspect you're not the only one who's noticed this - has anyone asked the board if they've received complaints? If so, ask how they're responding and if not, why not?

This can also be a safety issue - if passing by is limited to one car, that can make things difficult if an ambulance or fire truck needs to go by. Perhaps you can speak to your local police department about blocking the streets (call the non emergency number)?

Our Condo CCR's address this issue. Except for checking fluids or changing wipers, just about everything else is forbidden. Few people realize that motor oil as well as antifreeze, have a chemical reaction to asphalt, causing it to deteriorate, very rapidly. Our County Laws state the same thing, if you are on a public road. As far as doing this in your Community, it seems if this person is doing this in the road, your Documents may forbid this type of activity.
