Looking for some opinions on this subject. Small HOA with 12 single family residences. There is a perimeter fence around almost all of the entire subdivision. I say most because our developer died prior to finishing the fence in the subdivision. There is only one section that was never finished & had a little chicken wire fence. The adjoining property owner decided to put in their own fence & had their property surveyed to put in a really nice chain link fence with privacy slats - benefit to our sudivision because it closed off area where chicken wire was. However, behind two houses where adjoining fence was out in is a chain link fence the builder did install & now there is a gap between those two fences of about 4 to 6 inches. The two homeowners complain that weeds grow in between the fences and they want to remove the HOA fence. The BOD will be discussing this matter to decide whether to allow them to remove that fence. The biggest issue we see is what happens if any new homeowner wants to have that section of fence put back? Who pays for a it? As amembers we don't see taking down a perfectly fine fence just because weeds grow between it & the adjoining fence - then having to pay for a new fence down the road. Approximately 250 feet of chain link. Also neighbor says he has a friend who wants the fence so he will remove it for free.

KarenT Wash : If that's the biggest issue, what about comparative cost of 250 ft of chain link vs $1 worth of Roundup & landscape fibre to merely control weeds in the 4-6 inch gap ? Must be SOME bad weeds . . .

Or how about that regardless of how used or who 'did it', fencing above a boundary line is usually a mutual consent boundary line fence, as opposed to offset 'private fence' ? And if it's about common land boundary, isn't it a common element change with resulting complications ?

If the board decides to remove the fence and a future homeowner wants the board to put a fence up, you can say no. They bought the house without a fence there. The board can approve the fence-less future homeowner to put in a fence at their own expense on the property line, though.

It's one thing to change things while the current owners are there... it's another to worry about what a future homeowner might or might not want. You can only make decisions based on the information you have right now.
