We are having an issue with the management company charging late fees for payments made on time. Ex. I paid my dues in advance and got hit with a late fee. I'm assuming its an issue with their system, but I can not get anyone to respond about the incorrect charge. Normal late fees are billed after 10 days past due. These payments are automatically withdrawn by them or paid in advance. Any advice?

I would speak with the BOD about this issue, especially if what you say they are automatically paid in advance. Most HOA software that I have dealt with will have the parameters in place based on your governing documents, BUT they have to manually apply the process.

All you have to do is send them a copy of a redacted bank statement showing the item paid. Include a copy of the late fee notice. Send it certified, or if you have email, email them a copy and include several other homeowners in the hoa for back up. Then do nothing and wait for them to seek further action.

Don't get worked up about it, mistakes do happen and when it comes to mgmt. co. not all, but the majority of them can't keep their records straight from one HOA to another.

TC2, send the MC a copy of the front and back of the cancelled check and request the late charge be removed. We have had cases where a bank statement shows a check was issued by the bank but we never received it; and cases where the check was received after the grace period (10 days after the due date)for receipt had passed. Depending on the validity of your documentation the MC may void the late charge.
