Am I really responsible to pay a $200 (allegedly, my friend did not stop for a stop sign. He wants to appeal) fine? Why am I responsible for my guest?

Also, this friend lives out of state and we have requested a hearing date that will coincide with his next visit in August? Can the HOA refuse his request because it is over 30 days and the association is dark in the month of July?

In addition, they just raised the fines for speeding and rolling stops to $200. Isn't this excessive and is there anything we can do?

I'm on the Board of our HOA and our CC&Rs AND Rules & Regs clearly state that Owners are responsible for the conduct of their tenants, guests, contractors, etc. If one of them damages your HOA's common area, you'll be called to a hearing and perhaps assessed for the damage.

If one of your guests breaks written rules, where the fines are specified somewhere in writing, you are the one called to a hearing. The Board doesn't need your guest to attend. The schedule of violations and the fines attached to them probably are in you Rules and Regulations, but might be somewhere else. In CA the schedule of fines also is mailed out to Owners once a year with their annual budgets. Doesn't the hearing invitation letter state the document that the rule is in?

If it was the local police who cited your friend, the HOA probably is not involved. If you are a renter, the Owner of the condo/house is responsible.

May I ask if these roads are private or public? How does the HOA have the rights to issue speeding or other traffic violations? Just curious.
