Hi Everyone,

Long story short, when I purchased my condex I was given insurance as if it were a single dewlling. After 9 years, when trying to refinance, I found out the issue. I had to purchase the master insurance policy myself since my neighbor is in denial that we are a condo. At some point there was an association that has since been "dissolved" in her eyes long ago when one of the original owners sold their side. My neighbor also does not have the money to pay. I am on my second year now paying it myself. My question is how to go about creating a real association and ultimately, can I put a lien on their side? thanks in advance. Ps.. I live in Massachusetts.

A formally incorporated association would do nothing for you because majority rules and you will always have a tie vote.

Your choices are to continue to muddle along as you have or to compel your neighbor to do her part via court order. The latter option is expensive but will force her to either pull her own weight or sell to someone who can. Consult an attorney if this suits your needs.

It seems like another option would be to dissolve the condo association and "uncondo" the units. Maybe someone here can help, but my guess is that this is not a "DIY" project and you'd need a lawyer.
