Recently a spot opened on our board and our sub association pushed their president through on the spot. This man has always been hostile to the master HOA. He has a terrible temper and will often yell at someone who is speaking and beat his hands on the table. He's very loud and rude to everyone. Is there any way to get him off our board or to give him warnings about his actions that could add up to a dismissal?

Since he was appointed to the board he can be dismissed by a majority vote of the board as soon as he wears out his welcome. I do not believe that he is entitled to a reason or a hearing on the matter.

So, Harriet, you're a member of the master board. How many are on it? How many sub-associations are there?

Doesn't your master board vote to fill vacancies? If so, Larry's right and your master board can vote him off. Or, you can first try to censure him. We have never had to do that, but I believe the board would first give him a verbal warning that his behavior is disruptive and disrespectful. He must be civil and courteous or he will be censured. If he doesn't behave, censure him in an open meeting.

Maybe someone else know the details. I think this comes from Robert's rules of Order, but I'm not sure.

Doesn't he have to removed by the members of the association, not the board, regardless of how he got on the Board?

Don,

Basically, those who placed the individual in office are the people who can remove the individual from office.

However, it will depend on the language in the governing documents and applicable laws. Corporate laws tend to address these type of things but are only applicable if the Association is incorporated (most are but check to be sure).

Typically, if a Director is elected, only the membership may remove the individual. If a Director was appointed (typically to fill a vacancy), the individual may be removed by the Board.

Of course governing documents vary from Association to Association and laws vary between States. Therefore, check to be sure.
