Does anyone have any esperience of know that gate setback code? Our gates were put in around 2006 and we decided to keep them open all day but closed at night in 2010. We know want to keep them closed 24/7. But are being told it does not meet the set back requirements. Setback is how many cars can fit in the entrance without being in the street. And we would have to move the gates in more. I dont understand this since the gates were built before this code went into place woouldant we be grandfathered in?

John,

Grandfathering only exists if the statute authorizes grandfathering.
A good example would be the ADA act which required public buildings to provide handicap access by mm/dd/yyyy. There was no grandfathering in that act.

This may be the case for your gate.
A revised setback code may also be the reason for the decision to leave the gate open during the day.

Codes are typically an indication that this is a County regulation (County Codes). Therefore, I can not provide you a link to anything to aid you. Instead, I'd suggest contacting your County for a copy of the actual code and see if grandfathering is authorized or if you will need to adhere to the code as written.

Hope this helps,

Tim
