My husband, 10 year old daughter and myself have lived in a small HOA(17 homes)for three years now. The former owner and us have a private contract.Over a year ago a new president and treasurer(mother and son)took over and nothing has been the same. No one has a copy a the bylaws, no one has been alowed to see the books and a significant amount of savings is unaccounted for and any time you try to inquire with these two you risk them getting violent. I just need to know who to contact to enforce Colorados HOA laws of which these two have violated several.. Please help, We have loved this neighborhood and tried to contribute as much as a renter is allowed but now we are owners and still feel like we have no rights.

Roger who is a sponsor on this sight has a MC in Colorado and I am sure once he sees this post he will have some advise for you. I am in NC and I am not familiar with your state laws. Nonetheless, as Owner you do have rights, so I will suggest that you place your requests in writing to the board and send vaia regular mail and certified.

Deb, you can advise them that the Colorado Common Interest Ownership Act (CCIOA) requires every Common Interest HOA (manditory assessment) to provide owners certain information every year and the right to inspect record upon request. For details you can call me. Click on DARCO at the right side of this page to get my email address and phone number. There is no agency which will enforce the laws. You can try to get compliance; or if necessary, at a cost, an attorney such as one at HindmanSanchez (see left side of this page for info) or a management company such as DARCO can assist you.
