This is in regards to a community of townhouses. The townhouses have 1-car garages and a driveway that is big enough for one car. The driveways intersect the sidewalk, and then there is another small piece of driveway that meets the street. There are also a number of visitor's spots, though not enough that each house has one.

So imagine the overhead view like this

Similar to some past threads on here, there is policy stating that residents must park in their garage first, then driveway, and only then may they park in a visitor's spot.

There are two parking issues currently:
* The "garage first" rule is being violated by a number of residents, who leave a car in visitor parking even when their garage/driveway are empty.
* The "don't block the sidewalk" rule is being violated by a number of residents, who have three cars, with one in the garage and two in the driveway.

One person on the board would like to start towing cars from the houses where there are multiple cars in the driveway and the second car is obstructing the sidewalk. But the community already has a very limited number of visitor's spots, and without enforcing "garage first", those visitor's spots are going to be hoarded by the same people who are hoarding them now.

What should we do? Can we enforce one provision without enforcing the other?

Garage first can be arbitrary. Spots mark visitors only are not arbitrary. Parking on the sidewalk is not legal. Forget towing as it opens a real Pandora's Box. Start enforcing what you can enforce.

Contact your local police department and have the Association fill out the form allowing them to enter the development to enforce laws on the common areas (private property). Our Association does this on a yearly basis.

Then make an announcement in a newsletter that such an agreement has been entered into and the police now have authority to enforce on private property. Explain that things like vehicle registration, blocking of sidewalks, etc. may result in the police issuing a ticket. Give it a week or so after that announcement and ask that the police come through the neighborhood. Parking on the sidewalk will be resolved once a few tickets are given out.

I just joined the forum looking for ideas to a similar problem in our TH community.

Our parking committee having completed a community survey, maintains that our MAJOR PARKING problem is as a result of non-compliance with the "primary use/garage first" requirement, which is clearly documented in our CC&R's, but has never been enforced.

We already have the Police ticketing for parking across sidewalk and on street(which are city ordinances).

The problem is, currently 25% of the owners/tenants who are in violation of not using their garage first are taking all of the non-assigned guest parking spots (28 guest for 218 units) which leaves the other 75% angry that there are is no guest parking.

It would seem that a combination of enforcement and monitoring and control are required, but we need suggestions for drawing up a plan and implementing it.

Given your inquiry was over 2 years ago, just curious if your Board came up with any solutions?
