Their are two cars in my family, the HOA just placed new NO PARKING SIGNS out side throughout the community. I park in front of my door in front of the garage, which is u assemble for me now. My granddaughter parks right across from our unit, which she has done for over a year. I'm forced to park over 100 meters from my unit. It's winter, icy roads and snow are present. If She or I fall while walking to our unit, can I sue the HOA?

I'm not a lawyer and have zero knowledge of Michigan laws or your local ordinances.

Typically, you can bring legal action against anyone for anything (hence the phrase, you can sue a ham sandwich).

Winning such legal action will be based on various things:

Requirements of clearing snow (how long do they have)
What you did or didn't do to take precaution (did you have on slick sole shoes, were you wearing traction cleats for your shoes, etc.)
Weather conditions at the time.

Let me turn the tables a little bit.

If your daughter still parked across the street would you be asking this question?
You or your daughter still have the potential of slips and falls regardless of where your vehicle is parked.

It's your HOA why would you want to sue them? And while you could, I doubt you'd win. Whether or not they enforced the parking regulations in the past, it seems they are now.

It may be possible you are parking in a restricted fire lane.

You have 2 cars and a garage. Why aren't you using the garage?

I am sorry that this advice isn't taking the side of the OP. However, you have to remember we here are neither for or against HOA's. We are in the business of EDUCATING of one about HOA's. This is one of those cases where the parking rules are applicable by the HOA to enforce. Which means sue the HOA all you want (Suing your HOA is suing yourself and your neighbors)it is your right. However, realize the consequences of such actions. Why not just comply to the rules? Don't like them, then work with your fellow neighbors and board to change them.

You need to be able to take a joke. Tired of sue you HOA nonsense.

It's only nonsense because you don't like the reality of it. The reality is that you face consequences of suing your HOA. You either have to ACCEPT those consequences or find a BETTER way to get what you want. Which is where the EDUCATION of HOA's come into. If you understand how truly a HOA works, your knee jerk reaction would NEVER be to "Sue my HOA". It would be: "What do I do to EMPOWER myself and others to take action".

Humor only works if it's funny...

Richard, you are NOT progressing this board to any level except your own. I've got better things to do than to keep addressing you personally. My advice I give here is FREE, comes from experience, and is for HELPING people EDUCATE themselves on HOA. Other than that, I've got no need to address a bull in a china shop... thank you.

I didn't see that the OP was a "community leader looking to share and learn". Need to pay more attention in what's between the lines.

It's true that there are those who utilize this forum are not currently serving and may not ever serve on their Associations Board or in their committees.

However, it's also true that there are those who utilize this forum who are not currently serving but choose to serve in the future (that was me when I first found this site).

Regardless if they are serving now, will serve in the future or not serve at all, they are currently part of an Association and as a member, they have the most important job of all - to serve as the checks and balance for the actions of their Association.

You left out " a forum for community association boards and other volunteers to discuss topics concerning their association duties." I will always answer questions as a board president. I would fine them $100 a month for not using the garage if they were in my association. That is their FIRST parking space in our association.
