Our bod president allowed a Chinese director to be verbally assaulted at our bod meeting Monday. This was done by a half dozen members. They said they could not understand her. The president and vice president did nothing to to stop it. The next day the president went to a bod and said they were going to remove her because she is hard to understand. She was elected three years ago and this has not been an issue until this election. Is this addressed in Fl 720 ? thank you for any help

I was three long tables away and not near. I would been there had they approached her.

Doesn't Florida have an ombudsman for HOA issues? You might see if it also has a website that can explain the law in everyday English.

In the meantime, you and like minded neighbors need to stand up and say something at the next board meeting about this unprofessional and immoral behavior. It's bad enough that you have a bunch of bullies and boors in your community, but for the board members to sit there and do nothing was deplorable.

If the president (all of the board members, really) doesn't have the balls, cashews, stones (or whatever, take your pick) to insist on professional and adult behavior by everyone at an association meeting (these bullies can stay and home and howl all night if they want to), I have to wonder if they have the skill set to serve.

If the individual was elected, then typically only the membership may remove.

Based on what little you provided, I would not consider this an issue of discrimination.
However, depending on what the comments were (which you have said you were too far away to hear) that opinion may change. The verbal exchange may have been trying to understand and the lack of cultural similarities and language skills to better communicate.

I work with an individual from Vietnam. When he first came to the US he was employed at Gallaudet University where he was required to learn sign language and did not have the opportunity to use the spoken English language often. Combined with his accent, he is often hard to understand. However, over time and a willingness for he and I to communicate I understand him more today then when we first met. Unfortunately, others in the building don't want to take the time to understand and often dismiss him and look for others to resolve their issue.

In my opinion, this is not discrimination (racial or otherwise). This is simply the unwillingness of others to take the time that is needed. They, like many who go through life, feel there time is more important then yours. It can certainly make them jerks, but not racists (yes all racists are jerks but not all jerks are racists).

Was she Chinese when she was elected? Did she have the accent when she was elected? Why is this an issue now?

My observation is that in recent years hecklers have felt empowered to the point that there is no limit to their rudeness. I would be willing to bet that none of the members heckling this particular director has ever run for the board themselves or made any other positive contribution.

BTW, if she was elected by the members then she cannot be removed by a vote of the rest of the board.

Thank you. yes of course. The president knew this was going to happen. He told another director he could remove her. In my eyes this is racial. Her ideas and service was fine,her accent and looks were not. I will sit beside her next month. I would like to have the president explain his action but didn't see anything in 720. I appreciate all comments.

Sorry about my re-runs. Got distracted.

As Tim & Larry point out, the prez and board have no authority to remove an HOA member of an elected director from that position. If she is an officer, the board can remove her from that position.

To see how directors may be removed, read you bylaws, it should be in there.

Not clear to me--are you on the board, James?

The president is wrong. In Florida an elected director can only be recalled by the members. I don't see it as discrimination; it sounds like the issue is proficiency in English, not the person's race.
