Are CC&Rs standard throughout or are they different by area? If they are standard, is there a MODEL that exists that one should follow as an example ...one that would ensure that all of the legal issues(possible issues) are covered

Norman, state statutes vary and are constantly being updated. Therefore, there is no standard by state or within a state over time.

Even more specifically, every HOA probably has a different set of CC&Rs. You might find that one builder may use similar language between various developments, but that is just a coincidence.

The closest I've seen, is one developer who had a staff member who had a book and she wrote all the CC&R's for the developer's communities. It's been several years and I don't know the book's title...but you might want to try Amazon.com if you're interested in finding it. I've changed jobs (used to work for a MC) so I've lost contact with the developer.

Norman: if you search for your state's Planned Community Act, or your state doc. for assn. or condo living, your own community's governing docs, CC&R, should be patterned after the state doc. Not to say, your governing docs can have additional info, but not to go against state regulations.
Check out CAI in yellow on this site, key in your state.
