One of our board members is so arrogant that he refuses to place his name on the new ballot since he says we will not have a qourom and he would automatically remain in the position. Is this true, fair, legal? I believe it is not a legal thing to do since we have new community members that do not know him and is not familiar with his failures or doings.

Can anyone advise?

Basically he is correct. Name on the ballot or not, if there is not a Quorum then than there cannot be an election and the existing BOD stays in.

WHY is he so sure there's not going to be a quorum.

Work like heck to make sure there is a quorum and surprise him!
