Who do we contact to let them know our board is out of compliance/ The ex president is wanting us to "wait" until June/July to elect new directors: president etc because new laws for HOA are happening then.

Then there's nothing you can do and that's what my posts have been all about. You, and alot of other HOAs are in deep doo doo.

This is essentially a breach of contract issue, however, your documents may have a "hold blameless" clause in it that can only be oversome by exceptional circumstances. Ask the current board to resign and appoint new members until the election. If you let them stay, it will only get worse. They need to get mail with a government agency letterhead, or that of a lawyer.

the new board members do not want to take on any of the positions: I said I would and the board member that resigned but came back as "director at large" stated she didn't want me as president as I was not "professional enough." This is a volenteer board! This board has been run for 8 yesr by two couples and no one objected because our dues are so low.....I am the rabbit in a den of wolves. What government agency can I contact?

The only goverment agency is Department of Community Affairs. If the resigned in December why are you now trying to replace them? They should have been replaced in December! Check your by laws and see what they say. Your HOA Attorney should have stepped in and held an election along with your PMO.

I have tried to get the board members to do something and not ONE wants to do anything. The resigned president has all the board members believing that her job takes soooooooooooooo much time that they are all unwilling/afraid to take on the positions. They want other homeowners to volenteer to help out. My response was if THEY as board members don't want to serve in the positions whatever makes them think the residents would want to ? I volenteered to serve as president and was shot down by one of the women on the board who was an ex-neighbor of mine (This neighbor is the kind that you either get in the truck with her or she will drive over you).
HOA attorney? She is best friends with the two women who ran the board and then resigned and then came back on. I was involved in a lawsuit with these women and the attorney: Do not think I have much clout contacting her as a board member or concerned resident.
The residents in the association? I have spoken to many of them and as long as nothing affects them personally they could care less about this board. We have no amenities and we pay the max our bylaws allow for in dues....

Presidents should not have any more power than at-large directors. They just sign govt paperwork and contracts. They conduct the meetings, but how many follow any rules of order? You may find it necessary to bind them, blindside them, or embarrass them, especially about finances. If dues go up and they pay for nothing, "fraud" comes to mind!

no one wants to take over the positions. I tried and these women didn't want me to take over their places. The HOA attorney is their friend.
