My HOA insists that I adhere to the properly recorded Covenant and obey all the BOD Resolutions.

? Do I have any recourse ?

? Can 'they' force me to comply ?

Associations that utilize inspections to ensure the properties are in compliance with the governing documents will typically make those inspections in the Spring or Summer (we do ours in May). It may take from a few days to several weeks for notifications, based on those inspections, to be sent to the membership.

Therefore, this forum will likely always see a spike in issues about enforcement in the summer months.

1.) Yes. You can refuse, hire a lawyer, sue the association, and stomp your feet till the cows come home. If the covenants are properly recorded when all is said and done you will pay the fines, the lawyer, the court costs, the interest....and you will then comply.

2.) No, they don't have to force you to comply with properly recorded covenants. The courts take care of that.

3.) You can do anything you wish in order to fight them. Just remember that the meter is running and if the covenants are properly done, you will pay ALL expenses associated with your challenge. Plus, of course, the cost to comply.

Most people have found that, should they choose to live in an HOA community, it is easiest to comply with the covenants, and work to change those, through due process, that a majority of the residents feel are onerous. Of course, there are always those who feel they would rather throw away a few tens of thousands of their dollars, and their neighbor's dollars, making an a$$ of themselves.

Sarcasm and humor is often lost in the HOA environment... Matter of fact I think HOA stands for Humorless Oppressed A-holes forced to live in close quarters ruling over each other....
