If the BOD in a Illinois CICA,meets monthly when should the minutes of these meetings be circulated to the HO's??

In most associations, minutes from the last meeting are usually not approved until the next meeting and then made available after that.

my thanks to you for your responses. But can the BOD hold minutes for several months before circulating them? Especially when they plan and execute contracts for non-budgeted items?

We distribute minutes a few days after the meeting, usually between 2 and 4 days later. I don't think there's any legal requirement that the minutes have to be distributed at all. We do it as a convenience to the owners and because we think that keeping the owners informed is the right thing to do. We don't have to do it.

Minutes do become part of the HOA's official records that are available to any owner upon request. Not sure if that applies to approved minutes only, or if the most recent unapproved minutes are also covered. I think unapproved minutes should be included, but laws are generally pretty vague when it comes to minutes so you'd have a hard time asserting that.

Laws vary by State. Some States require draft minutes to be available within 60 days. To view IL law, see the following link:

(765 ILCS 160/) Common Interest Community Association Act

IL Condominium Property Act

If not mentioned within the statute, as others have said, only approved minutes would be made available.

As for contracts, once awarded, you should be able to review a copy of the approved contract.

Note: reviewing contracts and minutes is not the same as an Association providing you a physical copy of the contract/minutes.

What is your issues? Is it as you said, they spend money on non-budgeted items?

Some monies are allocated in general like say tree maintenance at $5,000.00 thus a contract for say $3,000.00 to ABC Tree Company would not be non-budgeted.

Do you have some specific examples?

Refer to your state requirements, if any. Then refer to your governing documents. IMO, transparency is a critical element of leadership. Our practice is to make all records available to all association members according to our Bylaws and CC&Rs, and upon request.
