Lived in an HOA in FL 4 years. Bought an equity membership in the golf club. The rules for selling it changed from the book we were given explaining them.
My name is on a list but I can't get list of names of memberships for sale. I am # 7 on one list and 104 on another and am told by local resident there is a third list also.

Jack - does this golf club limit membership? If you are no. 104 on the selling list I have to wonder how "restrictive" this club is. I think I would write this off as a loss and get on with your life.
If you are safely out of your HOA now, just curious why you are posting here? Harold

Good question. The HOA owned the golf course. Thus it was part of the HOA. It was represented as a seperate entity. Have you lived in FL in an HOA golf Club Community?

JackT1....Glad to see you have finally posted what state you live in......Florida has State Stautes that deal with HOA'S..........Go see SS 720.....with regards to the golf course try looking thru the Clerk of Courts records and see what exact papers have been filed with regards to the golf course.....You may need to put a request in writing to view what ever records you are seeking to look at...They have (10) TENDAYS to grant you access to those records...If not then file a complaint with DPBR.......LindaC

Thanks. Will do as you suggested and call Clerk of Courts and see what papers have been filed.

Address! Leesburg, FL. Pennbrooke Fairways HOA The HOA owned the Golf Club, but you could be a homeowner & not necessarily have to join the golf club. Name of club, "The Club at Pennbrooke Fairways". We bought an "Equity Membership" in the club in order to be sure we could sell our house. If you wish, call me at 865-357-4827 and I will return call immediately. We have unlimited LD calling.

Check back on any Brochures you received when you bought your place. Make sure that this business of "equity" members is written out. Also if you can find them check any advertizing in the past the HOA put out and make sure that all this stuff addresses "equity" membership requirements. I assume you mean that you got the golf membership in order to make the resale of your house easier. A developer here in SC started a program that stated if you did not belong to club you would have to buy a "certificate" at 5K to insure your buyer would be offered a timely membership in the club, if not, they would go on some list.
We took them to court and the judge made them do away with the certicate and provided that all new residents could elect or not to join club. One of the justification for the judges actions was that in the past, they had advertized that all new residents were elgiable to join club. Then they changed their minds so they could milk the cow for quick profit. I also believe some of the discussion in Chambers had to do with the developer's abuse of power. And when you think about it, in your case, the developer is using his position to intimidate as much as it is profit motivated. I would make sure the developer can legally restrict some people in the association and not others. Surely make sure the developeer is not giving away or selling memberships to ANYONE outside of the organization.
