I'll try to make this as short as possible. My subdivision stipulates that everyone use the same trash carrier. Recently we received a letter from the trash carrier that they would be reducing their single stream recycling pick up from weekly to bi-weekly. This poses a large problem for us, since the majority of our waste is recyclables. As a result of the change in service, we switched to a trash carrier that offers weekly pick up of recyclables. We then received a letter from the HOA, which only has one member, that we were in violation of the trash service ordinance and would receive a fine. Complicating the situation is the convoluted set up of our "subdivision." There are actually 2 additional smaller "subdivisions" within ours and they do not have a single hauler policy. As a result there are already several trash companies in our neighborhood every day of the week.

I have asked the 1 member board to hold off on any fines until the topic can be discussed at the next subdivision meeting in the fall. That request was denied. Is it legal for a 1 member board, (there are supposed to be 3), to impose a fine on residents if there is no quorum on the board? How can a fine be imposed since, in my opinion, the trash hauler has breached their contract by reducing recycling pick up? I have also requested from the board as well as the trash hauler, just the addresses (no names)of the other homeowners who had their recycling service reduced and was denied by both. How can I get the addresses, in order to talk to other residents with the same problem?

Well, you know the CCRs called for one trash service for the entire community - why didn't you go to the one board member and discuss your concerns? And note you have ONE board member - I'm not saying the man (woman?) is perfect, as one should still abide by the CCRs, but if no one else has stepped up to help (including you, apparently), what do you expect?

Start with that conversation - and an offer to help - that's one way to poll the neighbors and see who else recycles. If you don't have a lot of people to begin with, that could be why the company has changed the pickup to every two weeks, so you either live with it or persuade your neighbors to recycle so the weekly pickups can resume.

You might also check if the smaller subdivisions are subject to the same HOA - doesn't sound like they are, but your documents may have that answer. If they aren't, it doesn't matter what they do because your home isn't part of that subdivision.
