This has been an on going unknown since I have lived here. Looking for other HOA with similar issues, or ideas on resolution.

Our complex has private secured gated parking which you need a clicker to enter. Saying this we have no guest parking at all, all spaces are deeded to owners with exception. We have a few parking spaced designaged for disabled parking. We have on owner and another who use the disabeled parking as they are enttitled with placards.

For all intents and purposes we have the appropriate signage that there is no guest parking allowed, violators will be towed etc. and we have had a history of guests parking, owners renting to people in the neighborhood * not our buidling.. many issues with safety and secuirty, cars stolen etc.

A little while ago we had an owner who decided to let his disabled parent park in the disabled parking space, and they went on vacation for a prolonged period of time. Our other owners who park there were displaced as one of our owners in addition was now using the disabled bay due to a surgery they had. I heard we had our disabled owner walking a couple of blocks ot our complex as there was no parking for them to use, his own parking space is used also by a famly member and is not anywhere near the disabled parking.

Please adivse, can we prevent disabeled guests from coming into our private garage to use? Per ADA American Disabilities Act HOA"s are only required to provide ADA accomodations if the areas is a publically used area. Our garageis not , it is considered private parking.

The non-deeded parking spaces are owned by all owners in common. No one owner should ever be allowed to hand any of these spaces over to anyone; your association should have complete control over those visitor spaces.

In the case of the parents parking while on vacation, you should have had that car towed off immediately. The owner who allowed them to park there had no authority do make that decision for the rest of you.

You should place a time limit for parking in the visitor spaces, whether handicapped or not. I hate to be a hard-ass on this, but owners with disabilities should be parking in their own deeded spaces. If they are able enough to drive then they should be able to get to their cars.

The handicapped owner walking for several blocks because his own parking space was occupied by another family member should be shot, along with the rest of his family. What kind of morons are these? He should have no expectation of parking in a visitor's space, handicapped or not. It is also puzzling why this owner was willing to walk several blocks but then claimed he needed the handicapped space because his own space was too far away.

Limit parking to something reasonable, like six hours, and be prepared to tow if violators cause problems.

I will admit your response made me chuckle. I think there is some confusion. ALso owners who are disabled with assitive devices don't have the area between vehicles to open up and get a w/c or walker out. etc. We can't realistically ask an owner to park in his deeded sppt when is is disabled and has appropriate signage and what not. That is a discrimination suit waiting to happen and it's easily proven when boards go rogue with such stuff.

The family member who used thier spot instead letting the disabled park there, the distance isthe same. Walk with a walker is a struggle.. I suspect you should try it It can be done, and can be done for a few blocks.. people don't have to be a quadriplegic wheelchair bound person to be granted disabled parking.
