So I am about to buy a house in a lake community. My mother and I will be on the DEED and we will be the owners, the home is for vacation property only so we will only be there on weekends and things. I have searched the forums and found some interesting reads but was hopefully wanting someone that current a member of a HOA help me out some, thanks!

My mother owns a English Bull Terrier (The target dog)(spudz). No need to go in how kind the dog is and couldn't harm a fly but im concerned that the HOA might think it s a PITBULL or something "similar", can someone please read over this CCR Amendment pertaining the dog section and let me know what you would think. It is by far a PIT but just nervous about other people really knowing.

Amendment 10-A: Pit Bull Dogs

A. It shall be prohibited in the community of ** for any person to own, keep, exercise control over, maintain,
harbor, transport, or sell any Pit Bull Terrier.

B. DEFINITIONS:

1. an "owner" for purposes of this covenant shall be defined as any person who keeps, exercises control over, maintains, harbors, transports, or sells or any ownerships to be determined in the future of any Pit Bull Terrier.

2.A Pit Bull Terrier for the purposes of this covenant shall be defined as American Pit Bull Terrier, American Staffordshire Bull Terrier, or any dog displaying the majority of physical traits of any one (1) or more of the above breed or any dog exhibiting those distinguishing characteristics which substantially conform to the standards established by the American Kennel Club or United Kennel Club for any of the above breeds.

3. "Public Place" shall mean any street, sidewalk, alleyway, easement, buildings, playground, parks, and recreational facilities of amusement, entertainment, private owned, or facilities for sale, lease or any other use.

4. "Compliance" shall be defined as the removal of such animal from the boundaries of Five Lakes, as it concerns this Covenant. Payment of the set forth penalty shall not be in full compliance.

5. An "Offensive" pet shall for the purpose of this FLPOA be defined as, when unprovoked inflicts bites or bodily harm either in public place or on private property, also this covenant will have jurisdiction of offensive pets doing injury to other unrelated pets.

6. A "Vicious" animal shall be defined as exhibiting one or more traits. Brutal, ferocious, savage, ruthless, remorseless, merciless, heartless, callous, cruel, harsh, cold blooded, inhumane, fierce, barbarous, barbaric.

C. If the owner of such dog disputes the classification of said animal, the owner may submit a written petition with the
security manager

Hard to tell - It's an amendment, so obviously some kind of incident prompted the change.

Suggest that you send a video clip of your mom's dog to the security manager referenced in b6c. Get confirmation before you buy.

This sounds good to me. But I would want the Board's response in writing. Board members change frequently and a new Board may disagree with a previous board's decision.

Thanks for the replies. According to the UK and other parts of the US like DENVER where lot of this started it seems that BULL Terriers are welcome just nothing that is considered "PIT" it just seems like it is a fine LINE and not sure where it crosses even though the dog is nothing like a pitbull.

That is horrible, but not to get in a dog argument lol that happens with all breeds. I guess ill just purchase a WOLF and bring it with me. =)

I agree pitbulls do have a bad rep and I understand for the HOA rules but from what I have been reading "even in the UK" where the bans are, BUll Terriers are not part of the Ban. I just would hate to purchase a home and then they say you cant have that dog here without knowing any type of facts..

Overall the HOA seems pretty solid it was just that part had me concerned. After reading around online it seems that the English Bull Terriers are not going on any banned list but I could see a resemblance in them which could be portrayed to be a "pit" I really thinking of just rolling with it and if it comes up ill deal with it then its my mothers dog and so far this place has been on top of our list and dont want it to slip through.

Hi Steve
You can learn a lot about this HOA by asking for their opinion in advance. How responsive are they? Is there someone who is on top of this issue?

If nothing else, I would want to take this opportunity to speak with one of the board members.

Some HOAs are great places. Others aren't so nice. Find out how receptive this one will be to a prospective buyer.
