Hello,
I'm new to the group, but I am finding a lot of valuable information on this board. I am a board member of a small HOA in Ohio. In the past, the board hasn't done much to pursue delinquent HOA fees. I would like to start placing liens against the delinquent homeowners. Has anyone had experience filing these types of liens in Ohio? Is there anything we should be aware of that might get us into trouble? Your help is greatly appreciated.

You would want to check with your state laws and can be found by googling Ohio's Planned Community Act. A lawyer or collection agency could also help with liens. Proper notices must go to the Owners, therefore I would also check your state collection laws, as not to violate them as well.

Thanks Gloria. We are a small association, so we would like to avoid attorney costs. However, we do want to make sure we do everything correctly.

We don't live in Ohio, but this is what we did. We have an attorney that we ask questions of from time to time, and asked him about what to do. He told us to pursue filing a lien with the county, etc. We then contacted our register of deeds in the county to see costs, and what exactly we needed to submit and they gave me some examples. Finally we sent a certified letter to everyone giving them 30 days to catch up or contact us to arrange payment. About 1/4 did, the others didn't. I would advise at least speaking to an attorney on this.

Thanks Brad. I think I need to convince the other board members that it would be worth the cost to retain an attorney for the initial lien process.
