If you live in a development controlled by an HOA, you likely need prior approval from the Association.

Additionally, you will need to obtain the proper permits and comply with applicable County Codes and city ordinances. These can typically be obtained through an internet search.

Since laws vary from State to State and County to County, we really can't tell you specifically. Typically there is some sort of fencing and setback requirement. Your local pool company can probably help you to locate this information as well.
