What is the procedure for taking down barn swallow nests in a condo complex unit... Often times a barn swallow(which is a protected specie)will build a nest in the patio of a condo complex... oft times in the upstairs unit and owners/tenants often think that it is a bees nest. Unfortunately they do not always notify anyone until the nest is built and possibly has babies on the inside of the nest. Then is it the responsibility of the HOA to remove the nest(s) or that of the owner?

It is my understanding that you cannot remove the nest if there are eggs already in there. Once they hatch, grow up and leave, you should remove the nest because they use them over and over.

Is this the same person who complained in 2013?
At that time, you had contacted a wildlife rehab facility. Is this not an option?

In the previous thread, various suggestions were made about bird netting that could be put up at the start of the nesting season and taken back down later. Has the Board considered that option? Has the Board modified the rules to allow an owner to utilize that option?

As was said in the earlier thread, it depends on who is responsible for the balcony. Personally, I think it would be the owners responsibility (just as it is the owners responsibility for cleaning the patio). Your governing documents should clarify.
