For all those who read this, and it's the only post I'll make on this topic. I don't see the advantage to debating those who repeat the same old, same old tired sentiments.

If you are not getting results from your Management Company file a complaint with your local BBB even if the MC is not BBB accredited. BBB will contact them. You can also file a complaint with your State Attorney General. It's worth it to try. This can be done on-line.

If licensing is required, you can also make a complaint against the licensing bureau.

However, prior to making any complaint, you should do the following:

1) Read and understand the terms of the contract between the MC/PM and the Association
2) Approach the MC/PM directly to try and correct the issue.

Although Jim didn't say to first try and work the issue out with the MC/PM. I am positive that his post was with the intent that that had happened and failed.

If JimR isn't on the Board, I'd think he'd have tired to go through his Board first to try to get the MC to improve.

If he IS on the Board, then he should have tried to get his fellow directors to work through the alleged problems with the MC, or fire them and hire a new firm.

Either way, I assume you've read the contract between the HOA & the MC, right JimR?

I think Jim is simply listing options that the Board can use if their MC/PM isn't providing results you are expecting.

The BBB is a valuable resource.

In fact, (although not an HOA issue) when trying to get my name removed from companies who send me too much e-mail or make phone calls, I've found that after attempting to resolve the issue with the company with zero results, a complaint to the BBB got the results I was looking for and unable to achieve on my own.

Just a word of warning... Do NOT believe the "BBB" name on someone's advertisement. CONFIRM, CONFIRM, CONFIRM. It is free and all you have to do is go to the BBB site to verify they are really BBB members. Plus if they are, then you can also view their history with customers and how they addressed the issues. You can see how long they have been members. It's NOT free to be a member so it does take effort to be a BBB member.

I warn people of this as many of these "fly by night" roofing or construction companies put these on their flyers. Had one who did this to me and I checked. The BBB never heard of them. It was a bad cut and paste job too. You could see they had cut out the BBB words and made copies. The cut out lines were still around the words.

First off always remember the MC is a CONTRACTOR to the HOA. The board should be making the decisions and are in charge. It is NOT the other way around.

I always find threads like this difficult to respond to.
Maybe the complaint is that "my PM is a working mom and she's never available after 3pm".
Or maybe the complaint is that "the monthly reports are always incomplete."
World of difference. Nature of complaint should determine escalation path.
