I submitted an Architectural request in early March. It was originally approved by the dedicated arch committee based on what I see online. However the Board is saying they want to override the approval and will address it at the board meeting at the end of the month that will be 70 plus days since I submitted.

Is there a maximum time limit that is allowed on these type of requests? If that time limit is reached does it automatically approve? If yes, is there a law that I can bring to the board showing this in AZ?

Typically, any time limits are located within your governing documents. Occasionally, they are in State law, but not that often.

Read your documents and see if the Board has the authority to override an approval of the committee if the committee's decision wasn't appealed.

I do not recall ever seeing the topic addressed in AZ statutes. Like Tim said, if there is a time frame it will be in your documents.

Be careful. There was an expensive and nasty legal battle locally over a garage addition. The owner claimed the association had so many days to reply to his request and when they did not, he had the garage addition built. It went to court. he owner lost and had to remove the completed garage addition. He still screams but..but...but

As others have said, timeframes should be in your documents. The process should be defined in there too. 70 days seems excessive but based on the language in your docs, it's hard to say whether that equates to automatic approval or something else.

Also, I would think that you should receive some sort of official communication from either the Arch Committee or Board. I wouldn't proceed with making any improvements unless you have an approval in hand.

Also, take a screen capture or otherwise print out whatever you are seeing online as well as the communication from the Board on overriding the Committee's apparent decision. Who knows if you'll need that stuff in the future and if it will still be there (online) when you need it.

There is no specific time limit in our governing documents. I would absolutely not proceed!

To add to my original post. In the above case there was a 90???? day time limit in the documents and that is what the owner hung his hat on but the court ruled against him.
