we are a 100 unit central florida HOA. we have a community pool which is licienced by the florida dept of health as a public pool. we also have posted rules regarding user numbers and advising that pool is closed at dusk. we lock the enclosure at dusk however, we regularly have late night visitors who jump the fence and "enjoy" a midnight swim making all kinds of noise and leaving behind a mess. what remedies to we have to enforce the dusk closure rule.

Are there cameras at the pool--we have two and can identify the fence jumpers and noisy pool users, call them to hearing and fine them. I'm assuming it's the same two-three groups, yes?

Even though you close it, it still is lit, right? So, why not expand the hours?

Can your HOA afford a taller fence or one that's difficult to jump?

camera is a good suggestion but what do we do with the evidence. we keep being told since it is a public pool we cant charge for trespass.
anyone else have suggestion,

So the fence jumpers don't live in your HOA? They certainly are trespassing on your HOA premises, to get to the pool, right?

And I think "public" doesn't mean in the sense that anyone at all can cross your HOA common areas to use it!!

Again, do you have any security personnel? Are your premises --sounds like a condo-- gated?

Our pool is locked too from 10pm to 5AM, but the local law is that it still must have lights on in it for obvious reasons. I'm surprised that there's no lights required in your pool even with the locked gate.

Kerry is correct. It doesn't mean public access. You can call police.

Thanks, NpS, I couldn't think of the right language!

So it sounds like JimA can call the cops! Or their board members can. Or their security officer(s) can.

If residents, they can be called to a hearing & fined if your documents permit it.

Jim,

Good advice from the other posters. Keep in mind that a trespasser, who hops a difficult to climb fence, is purposely circumventing your "safety device" to keep people from accidentally (somehow) falling into your pool. That fence mainly protects you against off-hours lawsuits.
