My HOA is prohibiting to have any bicycles inside the unit. There is no secure storage available either. Is it legal? This is in the state of Colorado, Denver.

Are your condos in elevator buildings? Do you know WHY your HOA prohibits bikes in units? Or has it always been that way?

Is this "rule" part of your CC&Rs? Or just part of your rules & regs?

We don't forbid bikes in our high rise units, but we do forbid them being on balconies. We do have bike rooms in our underground garage levels, but a few owners worry about how secure they might be, so keep them in their units.

I can't imagine how bikes can legally be forbidden IN units, but am thinking there might be reasons to prohibit them being walked through, your common areas, say, elegant lobbies.

The rule is part of the rules and regulations.

There is an elevator in the building. It's only a three-story building and I usually take the stairs in the back, never through the front lobby. They do forbid everything on a patio that is not patio furniture (even a Dish, which is illegal to prohibit), so I do store the bikes inside. It's been that way since I have been here. I suspect that they worry that people will bump bikes on walls and things. Pets are allowed though.

Our HOA thought about this, but decided not to ban them in units, though we believe we have the authority to prevent them from being carried in halls and so forth. We have limited secure bike storage, but not enough. In Colorado the bike "lobby" is powerful and we simply did not want bad publicity and grief. What we do is carefully monitor them coming in and out and change for damage. They are banned from coming in the front door, but all large items are banned coming through the main lobby.

So, Peter, see if you can get owner support to change the rule. Rule changes often are not difficult if the Board is on your side. Roger, a CO Property Mgr. might know more about the rules change laws in your state. Your own rules might say how to do it.

Some changes might be that: bikes only can come up "the back" way (which I can't see in my mind.) Bike owners could be charged some kind of a damage deposit that would be refunded when they move or get rid of their bike(s). Do you by chance have cameras in your elevators? In our set-up, that's where any damage would be likely to occur.

I seems really unreasonable to me to not allow bikes to pass through your common areas given you have no bike storage rooms!!

In our 2 towers & 211 units, we have probably 75 bikes and perhaps 5-6 store them in their units.
