I am looking for model CCR language for our small townhouse HOA. 8 units. We need to renew and update as language is 30 years old. We no longer need the developer sections and we would like to convert to a "plain language" document. Can anyone help?

Any newer CCR could be of value.

We do have a lawyer who will review what HOA committee compiles

Your best bet is to work with your attorney, as he/she can help ensure you don't come up with something that's illegal or unenforceable. If the attorney can convert the documents to an everyday English version, that's a great place to start, as well as deleting the references to the developer.

Meanwhile, everyone should read the documents and see if there are any areas the current ones don't address at all or aren't clear or outdated and come up with suggestions. If there are only 8 units, everyone can take a section and summarize it for everyone else. Determine how your community has changed since it was established - a lot has happened in 30 years, I'm sure, and see where the documents are weak and shore up those areas.

Good advice from Sheila. Along with the developer language, many laws having to do with your type of HOA have been changed in FL. So there's probably some language in it that must be deleted or changed.

I can point you to one from 2007. This is NOT my HOA, but I found it while conducting a search akin to what you are doing. Go to this link -->Indian River County Official Records<-- and go into the "book and page" section. After you accept the disclaimer, make the Book Type "Official Records" and search for Book 2120 and Page 560. Instrument 1810847 should be at the top of the search results.

That will give you a 59-page PDF file which consists approximately of a 25-page CCR, 10-page Articles of Incorporation, and 20-page Bylaws (all in one PDF file).

I found it informative, esp. when compared to my own HOA's antiquated documents. Hope that helps!

Forgot to mention that they have amended their CCRs three times, in 2008, 2009 and 2010. Same search method see Book/Page 2233/710, 2388/2335 and 2412/1868.

As a relatively new HOA there's a lot of Declarant and Developer related stuff in there which may not be at all applicable to a more mature HOA. Still interesting. I don't know how "good" they are but it's the only set of documents I filed away for future reference besides our own. You can probably find others in similar fashion.

Locate one of the neighborhoods that was recently built and that is an HOA. Then pull their copy from the county or state website and see the differences for yourself and choose what you like or don't like.
