We moved in to an HOA about a month ago and have gotten 5 written complaints from the HOA since. Four of them were as a result of our next door neighbor complaining against us. One came directly from the HOA.

Four complaints from the neighbor were for leaving our garage door open for an extended period of time, Leaving our garbage can in the front yard, parking a vehicle on the street overnight and having our dog off leash. The one from the HOA was for a sign in our front yard for our pool contractor who is building our pool.

There is another pool being built down the street in our neighborhood and the HOA is OK with their sign but not ours. The signs are identical, just a different pool builder. The pool company tells me they are required to keep the sign in the front yard with their contractors license number on it and they have not had problem in the past. They have built many pools in this neighborhood. The other pool being built has a orange plastic mesh barrier to the back yard that the HOA told us we could not use.

Our garage door was open during our move as we were using the garage to move stuff into the home and off trucks. Many other people in the neighborhood leave their garage doors open all day. Our other next door neighbor has left theirs open over night. Another runs a business out of this garage and leaves it open all day with boxes stacked all over the driveway and in the garage.

If you drive through the neighborhood you can find a dozen or so garbage cans in the front yard especially for the couple days after trash pickup. Matter a fact my other next door neighbor left his in his front yard for three days and he did not get a complaint.

We left a truck and trailer in our front yard from about 7pm to 7am one day as we had no were else to park it. We needed the truck for moving furniture from our old home. 7am there was a sticker on the window from the HOA and a complaint letter came later. Most nights you can find vehicles being parked on the street overnight throughout the neighborhood.

Our golden retriever puppy slipped out of his collar one day for about 30 seconds and the neighbor just happened to be in his front yard so we got a complaint stating that we were spreading rabies with our vicious dog.

I am looking for ideas to make this harassment stop? Should I consult an attorney? I are in Tucson AZ.

Is there anything specific about you and your family that you think may be leading to this harassment? Are you perhaps of a different background/ethnicity than the majority of the other residents?

If so, you may want to look into contacting the local police about possible discrimination.

No, we are all the same ethnicity.

Sounds like your living next to the chief complaining officer. Nothing you can do and probably why the other person sold. If you live next to those people, they will complain to the HOA board and tell them they have to do something. Sometimes you have to make friends with the devil...
I do not get the whole gated community comments or bringing race into this conversation. The OP has a complaining neighbor problem not a money, race, or religion issue... BTW most of us here do not live in gated communities and it does not make anyone better if they do... Justin Beiber lives in one.... Mmmmm....

Actually we do live in a gated community.

We have tried to make friends but they guy will not even talk to us. He has in the past complained about a few of our neighbors but nothing like us. The house we purchased was new in 2007 and originally purchased by an investor. I has had a tenant in it for a short period of time but other than that it has been vacant. It is a little run down but we are working on that. No reason to hate us from the day we moved in.

Mike - Since you are new in the neighborhood I suggest first of all read your CC&R's and make sure your Board is correct with their complaint. Then respond to their letters. Be polite and advise them all their complaints have been taken care of and you will be more careful in the future to adher to the CC&R's like all the homeowners you have observed in the community and you are sure the ones not in compliance have also received letters. Unfortunately in an HOA what your neighbor is doing has nothing to do with what you do. I don't think it is necessary to go to an attorney unless the Board continues and you are in compliance with the CC&R's. Unfortunately the Board can't do anything about your neighbor except follow thru with his complaint. Whatever you do, don't confront him, this only adds fuel to the fire. I hope this helps. Maybe write a letter to your board president and ask about the garbage cans, the pool sign, and the other open garage doors. If the dog was off leash for a brief time and it won't be a usual thing then just ignore that complaint. There's a basic obligation that everyone should be treated equally. If you start to feel harrassed you should start by documenting everything that happens. Talk to your neighbors. Ask the board to clarify the restrictions and rules when they seem to be applying them only to you.

Our HOA is in a gated community, and for another perspective, I can tell you the garage door open for a day wouldn't be a big deal (many days would be a different story), the same for a pet off the leash for a few moments (again, as long as it wasn't a regular occurrence). Contractor signs wouldn't be allowed, but that would go for everybody, not just some. A garbage can left out for a whole day... again, not a big deal. We allow overnight parking as long as it's not for more than 24 hours.

Familiarize yourself with your HOA documents and state HOA laws (if any) before considering paying a lawyer for anything.

We have done exactly what you have suggested with no luck. We avoid any contact with the neighbor and try to follow the CC&Rs. We read them thoroughly before purchasing so we know what the rules are. The problem is in the real world following them exactly is pretty hard. Even our neighbor is in violation of a few things. We are not going to complain against him as we don't want look like we are retaliating or start a war.

The management company are actually really nice people. We are working with them on many projects, a new pool, landscaping, painting, etc. and they are easy to deal with. The problem is they refuse to stand up to this guy and in the mean time we are the ones who suffer. My problem is we have the right to live and enjoy our home like everyone else in the neighborhood. It is not cool that we have to constantly be worried that we may slip up and leave our garage door open a few minutes too long. No one else in the neighborhood has to worry like us. I think that makes it harassment.

I agree with you. I'm sorry if you misinterpreted my post about poking fun. My response was to Nigel not you. Sorry for the confusion. It seems as if Nigel and a few others were poking fun at HOA's by their absurd posts.

And Nigel's post particularly struck a nerve.

If you think this is harassment then maybe it's time to talk with your attorney. A letter from your attorney to the Board and your neighbor may stop them. It will probably help to ease your mind. It may cost your $200 or more, this is your decision if it is worth the price. Good luck.
