We are in PA. Our Declaration states the normal ...one family per household. It's come to our attention that one of our homeowners is renting out rooms in her home. The police have been called to the house on numerous occasions for domestic violence. What steps should we take to stop her from taking in tenants? Thanks

Do your documents state 'no business is to be run from home...'
If so, you could try that one since she is running a boardinghouse.
if there is domestic violence, that is also a 'nuisance' or
'disturbance' to other unit owners.
Further, check out what your docs state on unit owners 'renting' to tenants. If it is allowed, it means that the owner does not have to occupy the unit him/herself, but can 'rent it to a tenant'. That is not what this owner is doing.

I would check with the association's lawyer; get copies of any police reports available that relate to the situation.

We had a similar issue in our subdivision. Our restrictions say specifically "single-family residences."

Fortunately, our ZONING also restricts the buildings to single-family.

We were able to contact our local board of Inspections, Permits, and Licensing, which also is our zoning code enforcement mechanism and reported multiple-families residing in a structure zoned for single-family only.

They ordered the eviction of the renting family.

The homeowner then got ticked off and stopped paying his association dues when he found out we had reported him.

We now have a lien on his property, so we will eventually get not only the assessments, but a good size penalty fee as well.
