HI, our Condo Association is located in Massachusetts, and our Board of Trustees do not allow monthly open meeting to the owners, I cannot find any Mass. Laws saying it is mandatory, can anyone elaborate as to how I can seek information regarding open condo Board meetings information, so we can present to the Board asking their Board meetings become open. We have one Annual meeting per year and information is not trickled to us owners as they should be. Please, help, help!

The answer you are seeking should be stated in your covenant documents which you should have received at the time you purchased your condo unit.

Check out your bylaws section which should address Board members roles and Board meetings. It may very well state that Board meetings are not open to the general resident population, but 'can be' at the Board's discretion. Normally, in this case, the Board is bound to hold an 'annual meeting' each year whereby elections are held and a next year's proposed expenses/financial report is shared.

I can see why you may want to be more informed as to the Board's decisions throughout the year. You might try requesting a 'Town
Hall-type' meeting in which residents can discuss pertinent issues but there are no minutes taken and the Board does not have to render a decision at time to any concern or issue raised. However, this format does allow the residents to come together and for the Board to get a 'feel' for where the residents are coming from.

Art, have you googled to search for a MA sunshine law? Second choice if incorporated is to search the MA corporation laws. Several states, including CO have developed statutes which provide for homeowner input at HOA Board meetings. I persume you have already searched for these in MA.

Hi, PaulM, our By Laws only say, Board to hold Annual meeting at least once per year in October, and does not spell out open or closed meetings, but as owners we feel we need to know more throughout the year.

RogerB, I have researched Massachusetts Condo Laws 183a and nothing found regarding open meetings, Although Massachusetts State laws due cover all State, city meetings to be of open nature and go into detail regarding the open meetings.

For the most part, all other ASSOCIATIONS our area do hold open meetings and welcome it. We have finally put together a Concerned Owners Group in order to push for open meetings along with other issues.

Our by laws do state that 5o% of owners may call for Special owners meetings, which we will use if our Board refuses to allow open meetings. Yes, we can get rid of Boards without cause, but this would be the last Straw.
