Hi again all,
I need some more advise on proxies. Our BOD mailed proxies to us 3 wks ago. Last evening they left more proxies and a letter ( promoting themselves) on everyones door. The proxy mailed to us and the proxy left on our door are very different. The mailed proxy states we may assign our voting rights to a person of our choice or the BOD. The proxy on our door states that we assign our voting rights to a member of the BOD. This to me is very misleading.It also leads me to think they are preying on the ignorance of unsuspecting members. Is this legal? It does not state anything in our by-laws. I am in Texas.

Isn't it amazing what some people will do to retain control? Then you have to ask, "Why?" These are volunteers after all, aren't they?
Arizona has outlawed proxy voting. Might be a good idea to bring up with your legislators. Give them your HOA as an example. Harold

The mailed proxies are the correct wording, that you pick whom you trust with your vote for theat meeting only and that you have the right to take back the proxy should you attend the meeting.

The proxy left at your doors give away your vote to that board member who obviously wants in real bad. If the Owner signs it, he would then have the right to vote on their behalf.

In my humble opinion, Proxies are a very bad idea. Our Bylaws say that one resident may collect and bring in no more than 5 proxies total. If the owner doesn't know who to vote for, he/she can check one box that says that the secretary will assign your vote. (This doesn't sound quite fair does it? The secretary decides how to allocate the unassigned votes?). Then if some of the residents duplicate the proxies, they may go door to door and coerce proxy signatures from homeowners who won't even bother to fill them out. Next, the proxy collector will fill in the blocks for the candidates that they want to plug-in, and then mail in the proxy as if the owner mailed it in to the PM. We've seen it happen. Sooner or later, I feel that proxies will be either illegal or abaondoned in favor of a secure web-based voting solution. It's going to happen sooner or later. Yes, there is always that potention for computer fraud, but paper proxies are a joke and the risk of fraud is much, much higher. Many of the large communities are using the professional services of computer companies that specilize in secure web-based voting and I can't wait until we can implement this type of plan sometime down the road. Although we have to pay the computer company a few hundred bucks to administrate the vote, we'd still have to pay the PM, to print/produce and mail the proxies. Price-wise, it's not a big difference. It's inevitable that some day, paper proxies will be a thing of the past.

The meeting is over and it went according to the way the BOD intended. They had a lawyer there in case there was trouble over the 2 proxy issue. We were paying him $250.00 /hr.. The subject was brought up by a homeowner and they told the BOD it was a deceitful practice. They (BOD) just blew it off. I am in favor of your ideas of internet voting. It has to be a more respectful way of handling the election of officers. Especially our officers! So, we wait another year and see how much money we DON'T have left in our reserve account...and try again! Thanks for your help.

If anyone out there knows of other HOA's using Web based Secure Voting Solutions, then please let me know. You don't have to mention the name of the software companies, perhaps you can point me in the right direction to the HOA using secure web based internet voting services or email me with any recommendations. We are looking seriously at doing this for the 2008 election. I would really appreciate any recommendations.
