We presently have a rule that no alcohol in the clubhouse. The reason for this is that we did not want the liability associated with problems associated with anyone getting drunk and a) causing damage to the clubhouse; and b) leaving the clubhouse when driving and getting into an accident on the road and then stating that they had been drinking at a condo clubhouse. Does anyone else have any comments on this subject or any experiences with alcohol being used in a HOA clubhouse?

We have a damage deposit on our clubhouse. One puts down a $100 deposit for damages that does not get returned if we see any damage. I believe you need to check with your own laws about providing alcohol and liability. It is typically the party giver who is responsible in such situations. Having a no alcohol policy helps in putting proof that person holding the party disobeyed the rules. Making it a case against that person. That then protects the HOA. Reality being what it is, that rule needs to be posted but does not mean followed...

We have occasional events around the barbecue where residents are invited to bring their own drinks.

Personally I feel that your fear of liability for driving accidents is way overblown. The concern about damage may be reasonable if you have young and rowdy owners.

As long as the HOA is not serving the drinks, I see no liability. I would assume a Clubhouse Rental Form could be drawn up to further relieve the HOA of responsibiltiy.
