We recently have been informed by our contractor who was out doing work on our property there is a safety hazard on our roof.

The issue is a conduit that holds wires is exposed and it feeds to an owners AC unit.

Our board is split on who is responsible for this. OUR CCR's do not even touch this subject. Meanwhile I have been asked if we can just turn off the power to the unit on the roof until the owner gets it repaired. etc. I do not think any HOA has the abiliyt to make such judgements.

Once again the wires are exposed from a broken metal conduit that provide power ot the AC unit.

I think it's against all that i know to turn off any access to power for heat or AC to a unit, repairs meanwhile are minimal costs. ($200 dollars)

Based on my experience, the A/C unit and the wires are the responsibility of the homeowners it serves.

Has the BOD made the homeowner aware of the issue? As your docs do not address ... If owner aware what was their response? If I was the owner for a small amount of $200 for an item that could cause harm to my property I would be more than happy to pay for repair. If you have not contacted the owner I would recommending contact as soon as possible to resolve.

I'm trying to remember--you're in condos or town homes, right? Are you certain that your CC&Rs do not discuss maintenance obligations???

The owner of the A/C is responsible for its' proper and safe wiring.

? Who owns the A/C ?
