Our MC told us that when we try to vote our President out she can use Association Fund to fight us,Is that legal be cause we're voluteers,Doris B

Why would she need to spend money? CAn't the other two board members remove her from her office and appoint a new president? i don't see what she could be spending money on?

Doris, it is only legal if the Board approves the expenditure. Incidently, usually the By-laws allow the Board to remove the President from their office but not from the Board. Next I would be looking carefully at the MC who gave such bad information.

Our MC said it is a legal proces to get her out and to fight it she can use our fund's.our HO has more than 20% of signature to get the Board out because they tried to get the hole board out, they thought that would be easyer then just the president that is the one they want out.It is not in our By law that the other 2 members can vote her out. We where put in place as Board not be vote because their was not a forum.the HO who where that night namenated the 3 Boardmembers,and then the MC put us in Place,she wanted to be President and she got it, ,now the HO who where there said they namenated 3 people but the don't had the right to vote who they wanted for President.She does things like knocking on HO doors when they don;t mow or water in our By law it says that we have to do that in writing.So the neighborhood is very upset with what she does DorisB

The board members pick their positions after they have been elected by the homeowners. If the other 2 directors vote to change her position on the the board (to not the president - maybe sectary or treasurer or something) then there isn't any other process.

The only way to remove an elected offical from the board is by vote of the homeowners.

I guess my question would be why are you trying to remove her? If it is because she has missed so many meetings; most bylaws allow the remaining board to remove her. The could be so many variables, what is the reason?

No because she is not following our by laws HO are upset because she is knocking on doors and tell people what to do our by laws say we have to give written notice.But when HO have quetion for her they are not allowed to knock on her door,she will not have people come to her,the problem is I am the vice P and I am in the mittel off all this.HO coming to me to talk because I am listen and try to solve the problems.there are HO they put there House up for sale because she confronted them and they said we don't have to take this.and that is causing a big stink in the neighborhood Dorisb

Another good example of why everyone needs a concrete set of Bylaws. I think you would have a couple of options here but it all depends on how your Bylaws are written. First is to just remove her from her position as President by a vote of the remaining two Board members. You probably can't remove her from the Board without a vote of the neighborhood. I don't see how she can possibly use HOA funds to fight you though. If you are going to take the action of removing her, you and the other Board member should visit your bank manager about the situation and have him put a freeze on any changes or nonstandard activity to the HOA account.

If you do have enough signatures to call a special election and she's hacked off as much of the neighborhood as you say then I'd have your friends force a special meeting for the purpose of removing all the Board members and holding new elections. Have a replacement in the wings and let them hold new elections. It's doubtful your Bylaws prevent you from running for reelection if the Board was recalled. Hopefully this time she'll come in 4th! And even if she doesn't, it doesn't mean you have to let her play President again.

As far as being a volunteer goes, remember this great saying, "Let no good deed go unpunished!"

I just found out today that the Pres. of our HOA was asked to resign. Apparently there is a Veep who wants to run the show. Can the Pres. be removed without any input from the owners? I realize that you are unfamilar with our particular by-laws, etc, but generally speaking, can this be done?

AmK, As a general rule the President can be "removed" from his position on the Board (by the other Board members) but he cannot be thrown off the Board without the involvement and approval of the general membership. Of course your Bylaws may specifically address and approve this method of removal but most do not.

It appears that there may be some financial issues involving the VP and the PM. Our ousted Pres. has been trying to get some financial reports that he never received. His attempts may have caused the "removal". By way of the grapevine, one person on the board was the daughter of property owners, and I have no clue how she got there and was able to vote. Our problem is that there are few permanent residents. The VP is permanant and has been "bad-mouthing" our president for several months. (The current VP was President last year). We live out of state and I am very frustrated by these events. What should be our sequence of steps? I have been trying to locate South Carolina laws regulating HOAs and my right, as an owner, to try to get access to those questionable financial documents. As near as I can tell, the SC law is called the Horizontal Property Act and I think the chapter and section numbers are 27-31-180. After reading many of the posts, it seems that I am at the mercy of the PM as to WHEN I could see these documents, if I ever do.
