I am the vice president of my Homeowner's association and the developer of our community is refusing to turn over copies of the plans/specifications used in the construction of the common elements. We need these plans for an engineering report we are having completed. I welcome any advice anyone may have!! Thanks!

The copies should also be on file with the local municipality office in which you reside.

Try the register of deeds in your county, that is where they typically are.

On the West coast the plans and specs for a building would be filed with the Building Dept.. It varies from County To County how long they keep the info. Most Building Depts. will make a copy of the plans for a nominal fee.

Joshua, I would have the company completing the engineering report secure and provide as part of their report all plans, specifications, warranties, etc.

I agree with everyone that you or your professionals should be able to secure a copy of the plans from the municipality.

However, in New Jersey, developers have a statutory duty to turn over the plans and specifications to the Association. See NJSA 46:8B-12.1(d). Other states may have similar laws.

I owned and operated a management company in New Jersey for 12 years. My old company is still in operation today under a new Owner. I have to say now operating in North Carolina, NJ is one state that has the best laws that help HOA's that I have seen in my 25 years in this business. NJ is quick to enact laws that benefit both Owners and help Associations. I wish more states would look to some of the NJ Laws and enact them nationwide.
