We have had an ongoing problem with neighboring teenagers jumping the fence around the pool and using at their leisure. A new developement is going in and the developer asked me what could they do to help us out. I respondend with raising the fence around the pool and putting shepherd hooks in. They went for it, close to $15,000. The work is complete, no money out of our HOA pocket book.
Now members are complaining that we put these up. They like the look, but don't think we should have done it. The complaining homeowners think we should just open the pool to any one that wants to use it, no rules etc. These homeowners do nothing but complain. They don't show up at any social event, meeting but just complain about the slightest thing. I certainly feel like I should just tell to sell their home and move on.

I don't understand how you can complain and not even try to make things better.

You will have that anywhere you live, no matter what you do, how you do it, someone won't agree with it. That is ok, after all it is a free country and we are all entitled to our opinions, good or bad.

An approach for these homeowners might be to explain the severe liability the association faces without rules and securing of the pools. If one of those teens had drowned in the pool it is possible the association could have gotten sued. If you let anyone in without set policies and procedures you open yourself up. The days of just rolling out the ball and letting people play per say are gone. A responsible board has to think through every angle and what might happen. Yes, it would be great to let everyone use it, however, what happens when they get hurt? Who pays for the extra costs, if any.

Your insurance policy would probably prohibit non Owners usage as well. It is never a good idea for private pools to open up to public use. Liability is the big issue here. As for the Owners that complain:
