First wish you all Merry Christmas and Happy Hanukkah! Our property is 55 + in Fl, my neighbor's 45 yr. old daughter is moving from Europe with her mother who owns the apartment, the Board has requested the daughters background check? Is this legal? I think is outrageous, we checked the documents I don't see anything except if your are renting your property.
If any one out there had a similar experience please share.

If the neighbor's daughter is under 55, she really isn't qualified to live there in the first place - why didn't she check this out before returning to the US?

I don't know why the Board is requesting the background check - if it's not in your documents, you may want to check if the board has passed any resolutions on the issue. There may also be an issue with the government, as the place IS supposed to be 55 and over and the neighbor may have to verify her status for some reason (e.g. perhaps they make an exception if the daughter's physically handicapped or intellectually disabled). And if the mother plans to live elsewhere and the daughter wants to live in the apartment and pay rent, that may also explain the board's request.

They can ask. She can refuse.

The question is, what can they do if she refuses?

Since the only documentation is for renters and she's not a renter, I doubt there is anything they can do.

You are right, I checked the housing laws and as long as one person is 55 and over a person over 18 can reside. Thanks let's see how they are going to handle the refusal for background check of the daughter.

But the law also states that a facility can have more strict guidelines. Do your documents allow for someone under 55 to occupy a unit?
