Can the BOD decide to go to a management company in FL> or does the community vote on that?

Linda, normally the Board can decide without input from the community. The Board could solicit input from the community but they make the decision.

To add to Roger's response - if you are in a situation where you do not have a MC at all (versus changing companies), if that action requires additional funds (if you are planning a "special assessment" to kick-start your budget line item for the MC for example) you would then need to include the membership in this decision (explaining pro's/con's of why MC and not self-management) - and the purpose of this additional/increase in assessments. Once that is address you would move to allow the board to interview three or more companies that can handle your community (based on size, type of services required, etc) needs. At that point the board makes the selection and executes the contract with the MC.

That will be in your CC&Rs or bylaws.

In our case, we (the BOD) are allowed to pay someone to manage the affairs of the association so we could hire a management company. We would have to do this within the existing dues structure or take a community vote on raising dues to pay for this.

Thank you for the vital information. We will consider a management company, only as a last resort. The harassment that we are getting from a couple residents is wearing down this board. We are all volunteers and want to do the best we can. It would be so much easier if we didn't care, I guess.

We have the same problem in our association and I agree, it wears you down after a while.

Being self managed often puts neighbor against neighbor and it's tough to knock on your neighbor's door to tell him/her again that the trash is out on the wrong day or he's not allowed to keep his boat in the driveway. And after he tells you that he doesn't care, he'll do it anyway, how do you get along as neighbors?

On the other hand, it's tough to raise the dues to cover the cost of a MC when the members know that the additional funds are to hire someone to keep them in line.

Ronald, good insight. What we did is to hire a bookkeeper/accountant and NOT a management company. The bookkeeper did get the complaints but forwarded them to the board where we made the decisions. It's slightly different than a management company but still provided some of the benefits of a "cushion".I suggest finding an accountant and see if that will fit your needs better.
A hint about those "grading" homeowners. Maybe change the structure of your meetings. Simply say that questions will come at the end of the meeting and be limited to 2 minutes. Or ask simply issues be put in writing. There are ways in handling these members with still respecting their "opinions" without killing them.

Our HOA in Florida hired a MC as a board decision after solicting comments and inviting concerned residents to a board meeting. We have sufficient funds to cover the extra costs for a year. At that time we plan to have a neighborhood vote on whether to keep the MC and raise the fees, or go back to self-managed. We have about 10% of the residents who are really upset with this decision. Of course they are also ones who received violation letters this past year. Our boards have also been crippled in the past with trying to enforce the covenants against people who refuse to comply just for the sake of standing their ground.
We haven't taken an official vote, but surveys indicate about 75% percent of the residents support the decision. So far the management company has been a big help and some of the existing board members have decided to volunteer for another term. We are having our first really proper board election in years, complete with ballots and proxies instead of trying to get a quorum to a meeting.

Our problem people have stuck flyers, with their perspective on the painting contract,that the company is making an exhorbatant profit(which is untrue) without signing them. Now the rumor is another resident is trying to get us to have a meeting to discuss it. The assessment has already been passed by the community and 60-70% have paid or started to pay it. It was the board's decision which contractor to use. Since we didn't use the one this resident wanted( afriend of his), he is causing strife. The board was elected unanimously in Nov. The person I believe is spear heading this has not been involved until March of this year. Incidently, We have not recieved one phone call from ANY residents questioning our decision or the "flyer".

Those "flyers" are much like the unauthorized websites talked about in another current thread on this forum.
