I see this expression all over many docs including our own. My question is does anyone have a definition of such? Not just wording that says ones docs use the expression (as do ours) but a definition of such.

The reason for the question is all our standalone, private homes have a builder added privacy fence surrounding their backyard. While our association is responsible for all outside maintenance (landscape and house shell) our Covenants say the following:

(b) Sharing of Repair and Maintenance

The cost of reasonable repair and maintenance of a party wall or fence shall be shared by the Owners who make use of the wall or fence in equal proportions.


Some of our BOD Members are concerned that we may not have control over when and if fences need repair/replacement. I believe we do have such control based on our docs say Community Wide Standards must be met. Docs also say the BOD can notify an owner to meet such and if the owner fails to do such, the BOD can do the repair/replacement and bill the owner.

Your thoughts.

Fences, as well as all the exteriors of the home, should be maintained in good working order. If the fence is missing pickets or worn at the bottom, I do believe that it is reasonable to require the fence to be repaired (that is what we do).

With that said, the Board should adopt a resolution to define the standards for the community. Otherwise it will always be based on personal judgement.

Good point on developing written standards and in this case, I believe with every single home (112) having an identical fence, it would be a no brainer to define the Community Wide Standard for fences.

While we have some other less significant issues (like landscaping issues with say 10 of 112 homes), I believe the answer is for us to also define Community Wide Standards for landscaping.
