Hello all,

Are there any laws against changing a meeting time the day of? The HOA in question is in Texas.

Reason:

We have a BOD meeting scheduled for 8pm. The city just informed the residents that they will be spraying @ 9pm on the same night as the meeting.
In an attempt to avoid being sprayed as we leave the meeting, I was wondering if there are any legalities against moving the meeting up 1/2 hour on the day the meeting is scheduled?

Essentially we wouldn't be able to notify member of this change until hours before the meeting began.

Please help.

aside from quoruming issues, if your applicable statute(s) specify minimum prior notice of Owners Meeting, you may be technically compromising / rendering the whole meeting & decisions at it void. But if you can contemplate a meeting lasting barely more than an hour, maybe who will bother complaining at your HOA or condo community.

Thanks BobD4. It is just a BOD meeting, so I would get the other 4 to agree to a meeting prior to. I was hoping that a state (or common) law would be known by someone here. It sounds like I will have to go digging through our statutes.

If anyone else has experience in this, please share how your change went down.

For starters, as long as nobody complains, there's no problem. Do you typically get a lot of non-board attendees to the board meetings? Even if someone complains, I would imagine their only recourse would be suing, so unless someone is torqued enough to sink some money, you are probably in the clear there too.

It depends on what TX notice requirements are. In CA, owners must be given 4-days posted notice of time, etc. of an open meeting and the meeting's agenda. The notice must be posted where residents are likely to see it. But TX may be way different.

Some kind-hearted soul may look this up for you re: TX. But don't count on it.

Why can you not notify owners sooner than "hours" before the meeting? How many homes or condos are in your HOA?
