Our HOA in Florida just had our annual election. Two of the people being nominated ended up with a tied vote. Would you tell me how should that be handled. I don't think it was done correctly.

My solution would be to toss a coin if they are both agreeable to it. It saves money on another election (mail outs, ballots, cost of a meeting, time, etc). I would have the coin toss at the next board meeting.

Judy,

There are three options:

1) One of the two candidates withdraws their nomination.

2) The two candidates agree to a simple method (cutting cards, flipping a coin, etc.)

3) A runoff election is held (which means another meeting, notice requirements, etc.)

What was the incorrect way?

After the tie, the members should have had further questions for the candidates, discussion and debate, and then voted again at the same meeting.

The homeowners could scrutinize the owners list to determine if there were any ineligible voters.

Have another meeting.

Or you could dissolve the HOA according to Florida Statute 617.1430(2)(b) because The members are deadlocked in voting power and have failed to elect successors to directors whose terms have expired.

In elections for public office in AZ, tie votes (and they do happen) are usually decided by a simple game of chance, such as drawing a card from a deck. Whatever the candidates can decide on.

Do your documents say anything about elections and what will be done in the event of a tie?

I can't remember the last time we had more candidates than slots available.

If we had a tied vote for only one available board seat, one of our sitting Board members would probably offer to step down so that both could serve. (The resignation would open a seat which the board could fill by selection rather than election.)
