Our basic rules clearly state that our balconies ( which are open wroght iron style) may have fine mesh chicken wire as a barrier so pets etc won't fall through.

This is an older rule and for the most part has had no issues.. until recently when someone put up chicken wire that is colored with neon yellow zip tyes. You can see them from the ground level and it' frankly looks horrible

Past instillation of wire barriers were your typical plain metal wire until this.

Our board decided to update our rules to specify the color of wire. It was stated this owners green wire and neion yellow zip tyes need to be grandfathered and I am seem to not completely agree.

This is a split on our board.. curious if something as simple as this needs to be grandfathered.. the owner has a history of making every rule he has broken ( and there is alot ) a race issue, and our board is walking on egg shells around him.
Please advise. He is the only owner with a green fence and neonzip tyes.

If it would not be expensive for the owner to replace, I would not "grandfather in" his bright colors. Or you might consider having the Board pay for the less obtrusive wire once your rule is approved. That way I don't think "race" can be an issue.

But what is the Board "split" Nicole? Do you have an even number of directors on your Board?

Do recall that if the Boards decides on this rule change, you must send it out for a 30-day comment period to all owners. In that notice to owners explain car full the board's desire to have all units be uniform in this regard for aesthetic reasons. After that period, the Board makes its decision.

Those zip ties will not last too long in the sun and weather. Get with the owner and ask him/her to use plain wire ties when it comes time to replace them. IMHO, you have spent way too much time on this already. Give it a rest.
