Does anyone know if being on the ACC Committee, if you need the same insurance protection as the Board of Directors? I have read here that some ACC Committees submit their recommendations to the Board and the Board approves; however, our ACC Committee is set up that the Board does not have to approve applications, we do (ACC).

Does the HOA's DOL policy cover Directors, Officers, and CHAIR's (and Committees)...? If not, I would say that you do need to have insurance. Especially if the Committee is the "final" arbitor of ACC decisions (pass/fail). Even if your deliberations and procedures were perfect, you are going to encounter some owner who is willing to sue, based on a denial. Not sure what your exposure risk would be (provided that you are using a consistent procedure for pass/fail of changes)- although in your HOA/Committee structure I would say it is the same as if the board made the decisions.

Normally the Board of Directors approve the ARC's. However since yours does not flow through the board, I would suggest a Rider to your policy to include the ARC Committee. Talk with your Agent, perhaps there may already be a clause in the policy that covers committees. Your Agent would be the best person to speak with.

Tony, in Colorado we carry insurance coverage for all Board members, previous Board members , committee members, Agents, other members acting in an official capacity, and those who have served during the past 3 years. Normally the ACC is separate from the Board unless it is a small HOA.
